LAW OF OBLIGATIONS-I (GENERAL PROVISIONS)

Course Description

In this course, topics related to the Turkish Code of Obligations and systematics of relevant law are covered. In the first part, initial provisions of Turkish Code of Obligations, establishment of contract and obligations arising from the contract will be examined. In addition, issues such as the concept of debt, full debt and incomplete debt, assignment of the right to receivables, as well as errors, tricks, threats and lesion are analysed. In the second part, course, subjects such as freedom to make contracts, limitation of this freedom against public order and mandatory provisions, and impossibility in the law of obligations will be discussed. In the last part, unilateral or bilateral termination of the contract, termination and cancellation will be discussed.

4. L04 General transaction conditions, pre-contract, enforcement of freedom of contract: Absolute invalidity, full invalidity - partial invalidity, indirect declaration, mental registration, collusion and its types. SOLO 3
5. L05 Within the scope of this course, the old Law of Obligations and the new Law of Obligations comparatively, the systematics of the Law of Obligations, the basic concepts and sources of the Law of Obligations, debt and debt relationship, debts arising from legal transactions and especially contracts; Establishment of the contract, interpretation, completion and adaptation to changing conditions, invalidity, tort and unjust enrichment will be taught.
