Course Description

This course focuses on the United Nations Convention on Contracts for the International Sale of Goods (CISG). The course considers the application of convention rules to transnational sales of goods and compares this application with Turkish rules regarding sales of goods. The course, then, considers scenarios under which CISG applies to contracts for sale and questions the hierarchy between international application of CISG and its national effects. The course, furthermore, focuses on legal construction of contracts, obligations of parties, consequent liabilities for breach of contracts within the ambit of CISG. In its final section, the course draws upon European and Anglo-American influences upon the convention and compares the respective effects of these influences on general contract law.
